Before commencement of Pre-Evaluation
- To provide necessary information/documents as mandated by the 'Application for Certification' provided by NIWE.
- To provide assistance to the Certification division of NIWE for carry out the Pre-Evaluation.
- To execute a deed of indemnity along with the agreement to indemnify NIWE from all damages, loss, expenditures, etc incurred by NIWE in the event of violation of the terms and conditions by the CLIENT.
- To provide the confirmation that the claims would only be regarding certification consistent with the scope of the certification mentioned in the agreement.
- To provide the acknowledgment on receipt of communication / documents from NIWE such as agreement, certificate, project final output and the requirements of the certification scheme.
During the Pre-Evaluation
- To depute competent technical personnel to assist NIWE certification engineers to conduct the Pre-Evaluation.
- To make a detailed presentation about the codes, standards used for the documentation, readiness of the documentation, time frame required for documentation submission, changes introduced compare with originally certified model in the case of recertification, additional requirements, etc.
- To mutually agree that by virtue of signing pre evaluation agreement, there is no binding on any party for signing next phase of the certification agreement (i.e) signing the agreement for evaluation. The decision on signing the agreement for evaluation shall be decided only based on the outcome of pre-evaluation and the mutual covenant between the parties. Client has rights to take decision on signing the agreement for evaluation.
Pre-conditions for the Evaluation Agreement
- To ensure that the content and scope of the documentation are complete and satisfactory.
- To ensure that there are no changes in the design or component make of the wind turbine model during the evaluation.
- To agree that only one wind turbine of each type of the wind turbine model is verified unless otherwise specified in the written agreement.
- To abide any amendments. (The rules for the evaluation, during the evaluation process will be as per Certification Scheme. NIWE shall have the right to add any amendments during the evaluation with prior intimation)
- To provide all the necessary documentation / data / reports /information including participation of observers and access to the relevant equipment, location(s), area(s), personnel & subcontractors for the purpose of evaluation as required by Certification Scheme.
- To make necessary arrangements for carrying out the spot inspection of the wind turbine(s), installed of the type covered by the agreement and provide all necessary records & access to the relevant equipment, location(s), area(s), personnel & subcontractors during spot inspection
- To inform NIWE immediately regarding any change in the constitution of the CLIENT in the event of any amalgamation, merger or division of the CLIENT during the subsistence of this agreement, voluntarily without any follow-up from NIWE
- To inform NIWE immediately, of changes that may affect its ability to conform with the certification requirements such as major changes to the Quality Management System, modification to the product or the production method, etc. including the change in location.
- The client shall ensure that the wind turbine measurements reports / inspection reports submitted to NIWE shall be issued by the accredited testing laboratory / inspection body as per ISO / IEC17025 / ISO / IEC 17020. In case of the non-accredited test reports or inspection reports received from the client, NIWE shall verify that the party conducting the testing / inspection complies with at least the criteria of ISO / IEC 17025 / ISO / IEC 17020. The Quality management system of the client shall be certified by the accredited system certification body as per ISO / IEC 17021.
- To agree to provide the acknowledgment on receipt of communication / documents from NIWE such as agreement, certificate, project final output and the requirements of the certification scheme.
From the date of signing the Agreement for Evaluation
- To adhere the terms and conditions prescribed in Certification Scheme.
- To provide all the necessary information/documents to complete the evaluation process, as the documentation requirements of certification scheme of NIWE.
- To report on any failure, damage or breakdown, of the wind turbine(s) of the wind turbine model being taken up for evaluation in this agreement.
During the Course of Evaluation
- To report on any failure, damage or breakdown of the wind turbine(s) of the wind turbine model being taken up for evaluation in this agreement immediately without any delay.
- To provide all the required documentation, reports and information necessary for carrying out an evaluation for compliance to Certification Scheme, as per the time schedule. To Inform the list of wind turbines installed in the field of the wind turbine type subjected to evaluation as per the agreement.
- To inform the list of wind turbine installed in the field of the wind turbine type subjected to evaluation under the present agreement.
- To submit if any other documentation / information is required, on receipt of the letter from NIWE, the same within one week.
- To confirm that the claims would only be regarding certification consistent with the scope of the certification specified
- To mutually agree that by virtue of signing the evaluation agreement, there is no binding on any party for signing next phase of the certification agreement (i.e) signing the agreement for certification. The decision on signing the agreement for certification shall be decided only based on the outcome of the evaluation and the mutual covenant and have rights to take decision on signing the agreement for certification.
From the date of signing the Certification Agreement
- To adhere the terms and conditions prescribed in Certification Scheme.
- To report on any failure, damage or breakdown, of the wind turbine(s) of the wind turbine model being taken up for certification in this agreement.
Pre-conditions for the Certification Agreement
- To adhere that the content and scope of the documentation are complete and satisfactory.
- To adhere that there are no changes in the design or component make of the wind turbine model during the certification.
- To adhere that in general, only one wind turbine of each type of the wind turbine model is verified unless otherwise specified in the written agreement.
- To make necessary arrangements for NIWE for carrying out the spot inspection of the wind turbine(s), installed of the type covered by the agreement and provide all necessary records & access to the relevant equipment, location(s), area(s), personnel & subcontractors during spot inspection. If NIWE undertakes the spot inspection/surveillance.
- To inform NIWE immediately regarding any change in the constitution of the CLIENT in the event of any amalgamation, merger or division of the CLIENT during the subsistence of this agreement, voluntarily without any follow-up from NIWE
- To inform NIWE immediately, of changes that may affect its ability to conform with the certification requirements such as major changes to the Quality Management System, modification to the product or the production method, etc. including the change in location.
- To adhere and undertake that the wind turbine(s) shall be installed only at the site(s), meeting the design conditions and wind turbine class requirements of the wind turbine model after the issue of type certificate, if so issued by NIWE after successful Evaluation.
- To report any failure, damage or breakdown including incidents where the safety of a wind turbine or the surroundings are involved of the wind turbine(s) of the wind turbine model to NIWE voluntarily and immediately without any delay after the issue of type certificate, if so issued by NIWE after successful evaluation.
- To maintain the validity of ISO Certificate during the validity period of type certificate, if so issued by NIWE after successful evaluation.
- To submit renewed valid ISO Certificate including latest audit report documentation voluntarily, without any intimation from NIWE & without any delay.
- To report and get approved from NIWE for the implementation on any change from the certified Wind Turbine model, which includes design, drawing, documentation, specification and vendor change,
- To fulfill the certification requirements including implementing appropriate changes when they are communicated by NIWE.
- To provide an annual report consisting of information about the details of installed turbines, abnormal operating experience and failures of the certified wind turbine to NIWE.
- To provide necessary information/documentation and cooperation during the investigation of any incidents reported to NIWE.
- To provide the acknowledgment on receipt of communication / documents from NIWE such as agreement, certificate, project final output and the requirements of the certification scheme.
During the Course of Certification
- To report on any failure, damage or breakdown of the wind turbine(s) of the wind turbine model being taken up for certification in this agreement immediately without any delay.
- To inform the list of wind turbines installed in the field of the wind turbine type subjected to certification under the agreement.
- To submit if any other documentation / information required, on receipt of the letter from NIWE, the same within one week.
- To adhere not to use type certificate in such a manner as to bring the NIWE into disrepute and does not make any statement regarding its type certificate that the NIWE may consider misleading or unauthorized.
- To adhere, if provided copies of the certification documents to others, the documents shall be reproduced in their entirety.
- To ensure, while making reference in media such as documents, brochures or advertising in communication media such references are restricted only for the scope covered in the certificate.
- To keep a record of all complaints made known to it relating to compliance with certification requirements and makes these records available to the NIWE when requested and takes appropriate action with respect to such complaints and any deficiencies found in products that affect compliance with the requirements for certification, Documents on the actions taken. Make necessary arrangement for investigation of major complaints by NIWE.
- To cooperate with NIWE for the investigation of complaints received by NIWE on the certified Wind Turbine and shall comply with the decision of NIWE in resolving complaints.
- To confirm that claims would only be regarding certification consistent with the scope of the certification specified in the agreement.
- To ensure, if the certification applies to ongoing production, the certified product continues to fulfill the product requirements
Use of Certificates
- Certified clients may utilize the certificate in communication media such as the internet; brochures and marketing presentation.
- If the scope of certification does not include all products manufactured by the client, and/or all locations/facilities, then the client shall ensure that use of the certificates restricted only for the scope covered in the certificate.
- The clients shall not use the certificates provided by NIWE in such in a manner that would bring NIWE, into disrepute and lose public trust, and shall not make any statement regarding its product certification that NIWE may consider to be misleading or unauthorized.
- Photocopies or electronic copies of original “paper” versions of the certificates may be in full colour, and need to be watermarked or otherwise marked as being a copy of the original.
- The certificate can be used “as provided” by NIWE and cannot be altered or modified.
